Buy-sell rules.

  1. Concepts

    1. Seller – a natural or legal person specified in the order of the Goods, whose goods are sold in the e-shop www.mano-palepe.lt in accordance with these Rules and who is responsible for the execution of the order placed by the Buyer. The details of the Seller with whom the contract for the purchase and sale of the relevant product is concluded in accordance with these Rules shall be indicated in the Order of the Goods.

    2.  Buyer:

      1. natural person, i.e. a person who has reached the age of majority, whose capacity is not restricted by court order;

      2. a minor between the ages of fourteen and eighteen who has the consent of his or her parents or guardians, unless he or she is emancipated;

      3. legal person.

    3.  Parties – Buyer and Seller together.

    4. Personal data – any information about an identified or identifiable natural person based on the data entered at the time of purchase: name, surname, delivery address, telephone number and e-mail address.

    5. Rules – these "Rules for the Purchase and Sale of Goods "Mano Palėpė", which are applicable to every buyer's shopping in the e-shop www.mano-palepe.lt and each Purchase and Sale Agreement concluded between the Buyer and the Seller.

    6. Account – the result of the registration www.mano-palepe.lt performed by the Buyer www.mano-palepe.lt on the basis of the Rules, which creates a personal Account of the Buyer that protects his/her personal data and order history.

  1. General provisions

    1.  The Buyer confirms the Rules by familiarizing himself with them and ticking the check mark next to the statement "I have familiarized myself with the rules of purchase of goods in the e-shop www.mano-palepe.lt and agree with them". The Rules thus approved are a legal document binding on the Parties, which establishes the rights and obligations of the Buyer and the Seller, the conditions for the purchase and payment of goods, the procedure for delivery and return of goods, the liability of the parties and other conditions related to the purchase and sale of goods www.mano-palepe.lt.

    2. The Buyer confirms the Rules at the time of first registration by creating an account www.mano-palepe.lt. After the Buyer has approved the Rules at the time of the first registration (account creation), the Rules apply to all purchases made by the Buyer www.mano-palepe.lt and all purchase and sale agreements concluded with the Seller prior to the publication of the updated Rules. After updating the Rules, they shall be applied in accordance with the procedure discussed in this clause from the time of their publication www.mano-palepe.lt.

    3. Only Buyers, as defined in Clause 1.2 of the Rules, are entitled to buy www.mano-palepe.lt. By agreeing to the www.mano-palepe.lt use of the Rules, the Buyer confirms that he has the right to purchase goods www.mano-palepe.lt.

    4. In case of necessity or under the circumstances provided for in the legal acts of the Republic of Lithuania, "Mano Palėpė" has the right to change, amend or supplement the Rules. Shoppers will be informed about this in the e-shop www.mano-palepe.lt News section or when buying goods www.mano-palepe.lt after the entry into force of the new version of the Rules.

    5.  If the Seller has the right or obligation to provide the Buyer with information or documents by e-mail, in all cases the Buyer is responsible for providing the e-mail address that is functioning and belonging to the Buyer.

  2. Terms of purchase

    1. When ordering goods in an e-shop, the Buyer must indicate in the relevant information fields provided by the www.mano-palepe.lt his/her Personal Data necessary for the proper execution of the order of goods, which are processed in accordance with the procedure provided for in the Rules of Personal Data Gratification.

    2. When the Buyer, having selected the purchased product or service and formed a basket of goods, fulfills all the steps of the order, the last of which is the choice and confirmation of the payment method, it is considered that a legal relationship of purchase and sale has appeared between the Seller and the Buyer and a purchase and sale agreement has been concluded. The Buyer is informed about the order confirmation by submitting a notification by e-mail specified by the Buyer. The Seller sends the Buyer a link to the valid Rules together with the order confirmation to the e-mail address indicated by the Buyer.

    3. Each Order of the Buyer is stored in the e-shop www.mano-palepe.lt and the Seller's database and processed in accordance with the procedure provided for in the Rules of Personal Data Gratification.

  3. Buyer's rights

    1. The Buyer has the right to purchase goods and order services www.mano-palepe.lt in accordance with these Rules.

    2. The Buyer has the right to refuse the order in accordance with these Rules.

    3. The Buyer has the right to withdraw from the Contract in accordance with these Rules.

    4. The Buyer has the right to replace or return the purchased goods in accordance with these Rules.

    5. The Buyer has other rights enshrined in these "Mano Palėpė" Rules and legal acts of the Republic of Lithuania.

  4. Buyer's obligations

    1. The Buyer, using the www.mano-palepe.lt, must fulfil his/her obligations, comply with these Rules and other conditions clearly indicated www.mano-palepe.lt and not violate the legal acts of the Republic of Lithuania.

    2. The Buyer must pay for the ordered goods or services and accept them in accordance with these Rules. Having chosen to pick up the goods locally (in Klaipeda), the Buyer must collect them within the terms specified in the Rules by prior agreement of the time and place of withdrawal by e-mail.

  5. Seller's rights:

    1. "Mano Palėpė" has the right to cancel the Order without prior notice to the Buyer if the Buyer, having chosen the payment methods provided for in clauses 8.2.1 or 8.2.2 of the Rules, does not pay for the goods within 3 (three) business days.

    2. When the Buyer chooses the method of payment provided for in clause 8.2.3 of the Rules, the Seller, within www.mano-palepe.lt, in case of uncertainty regarding the information provided in the order, has the right to contact the Buyer with the details specified in the order. The time limit for delivery of the goods in this case starts to run from the date of contact with the Buyer. A customer's order can be cancelled without prior notice if:
      1. if the Seller fails to contact the Buyer within 2 (two) business days after placing the order, or

      2. if the Buyer does not provide the Seller with the requested information within the time limit specified by the Seller or

      3. if the Buyer does not provide the Seller with consent to the verification of his/her personal data.

  6. Seller's obligations

    1. The Seller undertakes to execute the Buyer's orders in accordance with the procedure established in these Rules and to communicate with the Buyer by means and channels belonging to the e-shop www.mano-palepe.lt and never to communicate with the Buyer through any other channels, unless this is provided directly in these Rules or in the e-shop www.mano-palepe.lt.

    2. The Seller undertakes to provide the Buyer with the information established in Article 6.228-7 of the Civil Code of the Republic of Lithuania in a clear and comprehensible manner.

    3. The Seller undertakes to respect the Privacy of the Buyer, to process the Buyer's Personal Data only in accordance with the procedure established by the Rules for the Processing of Personal Data of "Mano Palėpė" and the legal acts of the Republic of Lithuania and the European Union.

    4. Under the conditions provided for in the Rules, the Seller undertakes to provide the goods ordered by the Buyer and accept the goods returned by the Buyer.

    5. In the event that the Seller is unable to deliver the ordered goods to the Buyer due to important circumstances, the Seller shall inform the Buyer thereof with one of the contact details specified by the Buyer (by phone, sms or e-mail). The seller can suggest replacing the item with another one. If the Buyer does not agree that the goods not available to the Seller would be replaced by another product, the Seller undertakes to return the money paid by him to the Buyer within 14 (fourteen) business days, if a prepayment has been made, and in all cases cancel the order.

    6. If within 3 (three) business days from the submission of the offer, the Buyer has confirmed to one of the contacts indicated in the e-shop www.manopalepe.com that he/she agrees that the product would be replaced with another product and that it is cheaper than the first one, the Seller undertakes to compensate for the price difference. If the selected item is more expensive – the Buyer pays the missing amount www.mano-palepe.lt the default payment methods.

    7. The Seller undertakes to fulfil other obligations imposed on the Seller by the Rules and legal acts of the Republic of Lithuania.

  7. Responsibility

    1. The Buyer is liable for unlawful actions performed using the www.mano-palepe.lt.
    2. After registering, the Buyer is responsible for the storage and/or transfer of his login data to third parties. If the services provided by the www.mano-palepe.lt are used by a third party who has logged into the www.mano-palepe.lt using the Buyer's login data, the Seller considers this person to be the Buyer.

    3. The Seller is exempted from any liability in cases where the loss arises due to the fact that the Buyer, regardless of the Seller's recommendations and his obligations, did not familiarize himself with these Rules even though he was given such an opportunity.

  8. Exchange of information

    1. All communication related to the purchase of goods using the www.mano-palepe.lt, regardless of the Seller of the goods, is carried out through the contacts specified in the www.mano-palepe.lt, e-shop. In the event that the Buyer and the Seller carry out communication related to the goods in other ways than through the indicated contacts www.mano-palepe.lt, the Seller shall not assume any liability and risk arising from such communication.

    2. The Seller shall send all notices to the Buyer at the time of registration or ordering the goods at the specified e-mail address or by SMS to the telephone number indicated by the Buyer in accordance with the procedure provided for in these Rules, www.mano-palepe.lt The Terms of Use.

  9. Final provisions

    1. These Rules are established in accordance with the legal acts of the Republic of Lithuania.

    2. Relations arising on the basis of these Rules shall be governed by the law of the Republic of Lithuania.

    3. All disagreements arising from the implementation of these Rules shall be settled by negotiation. In case of failure to reach an agreement within 20 (twenty) calendar days, disputes shall be resolved in accordance with the procedure established by legal acts of the Republic of Lithuania.

    4. In the event that the Buyer does not agree with the response prepared by the Seller and transmitted by My Attic to the Buyer's written claim, the Buyer (natural person, consumer) may submit his/her request/complaint regarding the purchase of my Attic from the Seller to the State Consumer Rights Protection Authority (Vilniaus g. 25, 01402 Vilnius, e-mail: tarnyba@vvtat.lt, tel. 85 262 67 51, fax. (85) 279 1466, website www.vvtat.lt (as well as the territorial divisions of the State Consumer Rights Protection Authority in counties) - or fill in the application form on the ODR platform https://ec.europa.eu/odr/.
